ABC will assume liability for any damage to the test engines should such damage occur which can be reasonably attributed to the use of the test oil or any deviation from standard recommended maintenance practice as requested by ABC and agreed to by CUSTOMER during and for the purpose of the test. This liability will provide the same protection as normal engine warranty, i.e. labour and materials costs of repairing an engine. In no circumstances will ABC's liability for any claims or damages arising out of the implementation of the field trial exceed the costs of providing and installing replacement engines.

In the event of a dispute between CUSTOMER and ABC an independent evaluation will be carried out by an appropriate organisation and their decision will be accepted by all parties.

5. HSSE
CUSTOMER warrant that they are aware of and competent to deal with the potentially hazardous nature of the Samples and takes full responsibility for all heath, safety and environmental or other consequences which may arise from the possession and/or use of the Samples at CUSTOMER premises.
